Supreme Court interim docket adds border wall, immigration cases

Supreme Court interim docket activity is in focus this week as two high-profile immigration-related disputes move toward decisions that could arrive quickly.

On Oct. 21, the Trump administration returned to the court’s emergency docket, asking the justices to permit the resumption of border wall construction in the Big Bend region of southwestern Texas. According to filings, responses to the application are due by 4 p.m. EDT on Thursday.

Separately, three cities and an organization that provides legal services to immigrants have asked the court to pause an agreement between Texas and the Department of Justice that blocks enforcement of a Biden-era rule. That rule allows immigration judges to pause certain deportation proceedings.

The matter is fully briefed, and a decision could be issued at any time.
